Terms & Conditions

1              DDYCA will exercise all reasonable care and skill in its provision of the course/activity.

2.             Cancellation fees - Cancellations from clients must be received in writing.  Our cancellation fees are as follows:-

2.0          The deposit is non refundable

2.1          More than 6 weeks notice - deposit only

2.2          4-6 weeks notice - 50% of total fee

2.3          2-4 weeks - 75%

2.4          2 weeks and less notice - total fee.

3.             Reduced numbers - Cancellation fees apply to individuals i.e. reductions in number, as well as group bookings.

4.             DDYCA may by notice in writing to the customer cancel this contract:

4.1          at any time more than 28 days before the date when the course/activity is to be provided;

4.2          at any time within 28 days of such date if in the opinion of DDYCA it becomes necessary to do so by reason of explosion, fire, flood, power failure or other cause beyond the control of DDYCA or in the event that monies then payable by the customer have not been paid in full.

In the event of such cancellation (but excluding where monies then payable have not been paid), DDYCA shall repay without interest the deposit paid by the customer.

5.             Neither the customer nor DDYCA shall have any further obligation or liability to the other of them in relation to the course/activity following cancellation of its contract in accordance with paragraphs 2 or 3 above.

6.             The customer shall indemnify DDYCA against all actions, claims, demands, damages, loss, costs and expenses sustained or incurred by DDYCA as a result of:

                6.1          any breach by the customer of any of its obligations under this contract;

6.2          any acts, omissions or defaults of the customer, any of its staff, employees or other agents or any members of its party whilst attending the course/activity or at High Force Centre (including without limitation where such acts, omissions or defaults cause damage to the property or assets of DDYCA or result in a claim being threatened or brought against DDYCA by a third party)

7.             Except where this has been caused by the negligence of DDYCA, DDYCA does not accept any liability for any loss or damage to valuables belonging to the customer, any of its staff, employees or other agents or any members of its party.

8.             This paragraph 7 sets out DDYCA’s entire liability (including liability for the acts and omissions of its employees and other agents) to the customer in respect of any breach of this contract, any representation (unless fraudulent) and any act or omission (including without limitation negligence) of DDYCA in relation to this contract (together “an Event of Default”):

8.1          DDYCA’s liability for death or personal injury resulting from negligence shall not be limited;

8.2          DDYCA’s liability for other loss or damage arising from negligence shall be limited to the sum of £500,000;

8.3          DDYCA’s liability in respect of any other Event of Default shall be limited to the price payable by the customer for the course/activity;

8.4          DDYCA shall not be liable for loss of profits, goodwill or any type of special, indirect or consequential loss (including without limitation loss or damage suffered by the customer as a result of an action brought by a third party), even if such loss was reasonably foreseeable or DDYCA had been advised of the possibility of the customer incurring the same.

9.             The customer may not assign any right or benefit under this contract.

10.          The terms of this contract set out the entirety of the agreement between DDYCA and the customer as to its subject matter and supersede and extinguish all prior agreements, understandings and representations (excluding fraudulent representations).

11.          This contract shall be governed by and constituted in all respects in accordance with English law to whose exclusive jurisdiction DDYCA and the customer submit.

Organisations booking the centre must provide adequate support staffing for their group. They must take responsibility for the conduct of their group throughout their stay.
